Benedikt advises on all issues of intellectual property and copyright law, including technical IP rights.

The focus of his practice is on litigation before German courts in unfair competition, trade mark, design and copyright law. He has extensive litigation experience in these areas of law from numerous preliminary injunction and complaint proceedings before all relevant regional and higher regional courts. In these fields, he represents start-ups as well as medium-sized companies and global corporations.

Benedikt’s main activities in the area of unfair competition and advertising law include the strategic review of advertising appearances and campaigns. When assessing advertising campaigns with regard to their admissibility under competition law, his clients benefit from his extensive experience in unfair competition litigation, for example on misleading claims, comparative advertising or market conduct regulations.

In trade mark law, Benedikt has particular expertise in the protection and enforcement of non-traditional forms of trade marks such as colour marks and three-dimensional marks, which are subject to special legal requirements. Together with his clients, he develops individual strategies for the protection and enforcement of such marks. This also includes, for example, advising on demoscopic surveys on the distinctiveness of trade marks or coordinating complex trade mark disputes in multiple jurisdictions.

Benedikt also advises on contractual aspects of intellectual property law, for example on the drafting of licence, joint venture or research and development agreements. He is also regularly involved in reviewing the admissibility of general terms and conditions and defending such clauses against claims under the UKlaG.

Benedikt was admitted to the bar in 2012 and Certified Specialist for IP Law. His responsibility for the area of IP rights in the legal department of a leading European operator of DIY and garden centres as part of a secondment shapes his understanding of commercial corporate interests.
